The Bankruptcy Process

Bankruptcy is a person's legal right to file a petition in federal court that allows that person to seek to discharge all or most of their debt. The means test is used to determine which bankruptcy protection plan you may pursue.

When you can no longer manage your debts, you may be able to wipe them away through a Chapter 7 liquidation bankruptcy. Under Chapter 7, certain debts that are not secured with collateral, such as credit card debt, payday loans, personal loans and medical bills, can be discharged.

Those who do not qualify for Chapter 7 based on the means test, or those looking to avoid a foreclosure, may be eligible for a Chapter 13 debt reorganization plan that allows individuals to repay most or all of their debts within a three-to-five-year time period. This plan can help individuals facing foreclosure or repossession by placing the arrears or car payments within the plan, allowing individuals time to catch up on payments and maintain the property.

The Automatic Stay

Both Chapter 7 and Chapter 13 bankruptcy protection include an automatic stay on all legal action against the petitioner in the pursuit of collecting on a debt. That means filing for bankruptcy automatically prevents creditors from contacting you or filing a lawsuit against you, including:

  • Wage garnishment
  • Bank levies
  • Repossessions
  • Property tax sales
  • Evictions
