CRIMINAL DEFENSE

People accused of a crime have certain constitutional rights. Some of these rights are the right to remain silent, the right to an attorney, the right to a jury trial, the right to be confronted with the witnesses against you and to present your own witnesses.


An arrested person should only give information about her identity – name, address and date of birth. Providing more information can be very dangerous as that information can be used against you. A person should exercise the right to remain silent even if not arrested. Police officers might try to persuade you that if you are honest and admit to your guilt, they will not file charges or will be more lenient. That is not true! In fact, they will use that information to convict you.


Ask for an attorney to be present as soon as possible. Once you do this, the arresting agent cannot question you any longer. If they continue interrogating you, your statements will be suppressed, meaning they will not be used against you in a court of law.
